Terms of Service

These Terms of Service govern your access to and use of Online Forever Music, including our website, memberships, digital downloads, creator and vendor tools, community showcase features, and related services made available in Canada and internationally.
By using the service, creating an account, making a purchase, or uploading content, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
1. Eligibility and Accounts
• You must be at least the age of majority where you live, or otherwise permitted to use the service with any required parent or guardian consent.
• You must provide accurate information and keep your login credentials secure.
• You are responsible for activity under your account and must notify us if you suspect unauthorized use.
• We may suspend or close accounts that violate these Terms or present security, fraud, legal, or platform risks.
2. Our Service
Online Forever Music offers digital sample packs, memberships or subscription features, creator or vendor tools, community features, editorial content, and related services. Features, pricing, and availability may change over time.
3. Purchases, Subscriptions, and Refunds
• Prices, plans, credits, availability, and promotions may change prospectively.
• Digital products are delivered electronically, and access to some products or features may require an account.
• Payments are processed by third-party providers such as Stripe. You authorize us and our providers to charge the payment method you select for applicable purchases, subscriptions, taxes, and related fees.
• If you enroll in a subscription or recurring plan, it may renew automatically until cancelled in accordance with the plan terms and applicable law.
• Refunds, credits, cancellations, and billing adjustments are governed by our Refund Policy, any plan-specific terms presented at checkout, and mandatory consumer protection laws that apply to you.
Payment abuse, chargeback fraud, or attempts to bypass billing controls may result in suspension or termination of access.
4. Digital License and Allowed Uses
Unless a specific product page, download screen, or separate license says otherwise, purchases give you a limited, non-exclusive, non-transferable right to use downloaded sounds in your own music and audiovisual projects.
• You may use purchased or properly accessed royalty-free content in your own productions, subject to any product-specific limits or disclosures.
• You may not resell, redistribute, share, sublicense, upload, or make standalone sound files available to others, whether free or paid.
• You may not repackage our content into another sample pack, preset pack, sound library, training dataset, or competing service.
• You may not claim ownership of raw files, producer branding, trademarks, or site content you did not create.
• Where a pack or sound includes additional restrictions, disclosure obligations, or special licensing terms, those more specific terms control.
You remain responsible for how you use content in final works, including clearing any third-party rights outside the scope of our license and complying with platform rules, Content ID systems, distributor rules, or local laws that apply to your release.
5. User Content, Vendor Material, and Showcase Submissions
If you submit files, text, images, applications, comments, or other material to the service, you retain ownership of your original content. However, you grant us a worldwide, non-exclusive, royalty-free license to host, copy, display, transmit, distribute, moderate, and technically adapt that content as needed to operate, review, secure, and promote the service.
• You represent that you have the rights and permissions needed to upload and share the content.
• You must not upload malware, infringing content, unlawful material, or content that violates privacy, publicity, or other rights.
• Public-facing community or profile features may make your content visible to other users or the public.
• We may remove, reject, disable, or moderate content at our discretion, including for legal, safety, quality, or policy reasons.
6. Prohibited Conduct
You agree not to: break the law; infringe intellectual property or other rights; harass or impersonate others; scrape or reverse engineer the service; bypass security or access controls; use bots or automation in unauthorized ways; interfere with service availability; upload harmful code; attempt unauthorized access to accounts or non-public systems; or use the service to build a competing library or dataset from restricted content.
7. Intellectual Property
The service itself, including our site design, software, trademarks, logos, text, graphics, and non-user content, is owned by Online Forever Music or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights.
8. Availability, Changes, and Termination
We may change, suspend, or discontinue any part of the service at any time. We may suspend or terminate access if we believe you violated these Terms, pose risk to the service or others, or if we are required to do so by law. Sections that by their nature should survive termination will continue to apply.
9. Third-Party Services
Certain features rely on third-party services, such as payment processors, login providers, email services, analytics providers, or hosted infrastructure. Your use of those third-party services may also be governed by their own terms and privacy policies.
10. Disclaimers and Limitation of Liability
The service is provided "as is" and "as available" to the fullest extent permitted by law. We do not guarantee uninterrupted availability, error-free operation, or that content will meet every purpose.
To the fullest extent permitted by law, Online Forever Music and its affiliates, officers, employees, contractors, licensors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from or related to the service.
If applicable law does not allow certain exclusions or limitations, those exclusions will apply only to the extent permitted.
11. Indemnity
You agree to indemnify and hold harmless Online Forever Music and its affiliates, officers, employees, contractors, and licensors from claims, liabilities, damages, losses, and reasonable costs arising from your content, your use of the service, or your breach of these Terms, to the extent permitted by law.
12. Governing Law and International Use
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. If mandatory consumer protection laws in your home jurisdiction give you additional rights, those rights still apply.
Unless applicable law requires otherwise, disputes arising from these Terms or the service will be brought before the courts located in Vancouver, British Columbia. If you access the service from outside Canada, you are responsible for complying with local laws that apply to you.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version here and revise the last-updated date. If you continue using the service after the effective date, you accept the revised Terms.
